The traditional legal verdict of not guilty by reason of insanity as well as the more recent verdict of guilty but mentally ill rest on often unquestioned epistemological assumptions about human behavior and its causes, unjustified reliance on forensic psychiatrists, and questionable, if not deplorable ethical standards. This paper offers a critique of legal perspectives on insanity, historical and current, based on the altermative epistemological and ethical assumptions of Thomas S. Szasz. In 2011, the Department of Health and Human Services proposed changes to the regulations that govern human subjects protection in federally funded research. The proposed changes involve modifying inclusion standards for minimal-risk research and removing the necessity of review from certain categories of noninvasive research. All studies would instead be required to comply with privacy protections as initiated by the Health Information Portability and Accountability Act . We argue that relying on HIPAA to protect participants from participation-related risks in noninvasive (...) research is insufficient to protect the autonomy and psychological health of potential research participants. Large retrospective analyses have demonstrated that patients requiring MMF dose manipulation due to adverse events experienced a higher rate of rejection and graft loss. Enteric-coated mycophenolate sodium was developed with the goal of improving upper GI side-effects. Here, we review the efficacy and safety of EC-MPS in de novo kidney transplant recipient, and in stable renal transplant patients who were converted from MMF. The Centers for Disease Control and Prevention recommends routine human immunodeficiency virus testing of every client presenting for services in venues where HIV prevalence is high. Because older adults have particularly poor prognosis if they receive their diagnosis late in the course of HIV disease, any screening provided to younger adults in these venues should also be provided to older adults. We examined aging-related disparities in recent and ever HIV testing in a probability sample of at-risk (...) adults seeking services in needle exchange sites, sexually transmitted disease clinics, and Latino community clinics that provide HIV testing. Using multiple logistic regression with generalized estimating equations, we estimated associations between age category and each HIV testing outcome. Even after controlling for covariates such as recent injection drug use, older adults had 40% lower odds than younger adults did of having tested in the past 12 months or ever. Aging-related disparities in HIV testing exist among clients of these high HIV prevalence venues and may contribute to known aging-related disparities in late diagnosis of HIV infection and poor long-term prognosis. I develop and defend a sense-datum theory of perception. My theory follows the spirit of classic sense-datum theories: I argue that what it is to have a perceptual experience is to be acquainted with some sense-data, where sense-data are private particulars that have all the properties they appear to have, that are common to both perception and hallucination, that constitute the phenomenal characters of perceptual experiences, and that are analogous to pictures inside one’s head. But my theory also diverges from (...) conventional sense-datum theories in some key respects: on my view, (1) sense-data are first-person presentations of neural states, (2) the sensational qualities of sense-data differ in kind from the sensible qualities of external objects, and (3) sense-data are the vehicles in virtue of which we perceive, rather than the objects that we perceive. I argue that this package of claims is appropriately labeled ‘sense-datum theory’, and that the resultant view ought to be a live contender in contemporary philosophy of perception. (shrink)

This paper argues that there is an inconsistency between Jaegwon Kim's earlier work on supervenience and his more recent work on explanatory exclusion. In his work on supervenience Kim advocates an explanatory agnosticism that, by the time of his later work, is replaced by an endorsement of reductive explanation. My argument is that this tension between Kim's early and later work is unfortunate since explanatory exclusion is highly questionable in its own right and is not reconcilable with his earlier work (...) on supervenience anyway. /// El presente artículo sostiene que existe una inconsistencia entre los primeros textos sobre superveniencia de Jaegwon Kim y sus trabajos más recientes sobre exclusión explicativa. With the growth of precision medicine research on health data and biospecimens, research institutions will need to build and maintain long-term, trusting relationships with patient-participants. While trust is important for all research relationships, the longitudinal nature of precision medicine research raises particular challenges for facilitating trust when the specifics of future studies are unknown. Based on focus groups with racially and ethnically diverse patients, we describe several factors that influence patient trust and potential institutional approaches to building trustworthiness. Drawing on (...) these findings, we suggest several considerations for research institutions seeking to cultivate long-term, trusting relationships with patients: Address the role of history and experience on trust, engage concerns about potential group harm, address cultural values and communication barriers, and integrate patient values and expectations into oversight and governance structures. The primary aim of this paper is to provide the exact diagnosis of the contingent a priori debate so far by untangling complicated issues surrounding it, such as singular thought, linguistic stipulation, and epistemic justification. I will first maintain that most philosophers' arguments for or against the contingent a priori are ultimately based on one of two conflicting intuitions about linguistic stipulation: sceptics of the contingent a priori have appealed to the intuition that extra-linguistic knowledge cannot be acquired through the (...) stroke of a pen, whereas proponents of it have appealed to the other intuition that one is in a position to understand a name that one introduces by oneself into one's own language. Then I will reconstruct the sceptics' and proponents' positions in their strongest form respectively and examine where they disagree, and finally I will argue that the contingent a priori debate cannot help but end in a stalemate without further scrutiny into singular thought. From this diagnosis, I conclude that in order to appropriately judge whether a contingent proposition is knowable a priori, we must first independently investigate what the conditions for singular thought are: the contingent a priori rides on the singular thought debate. Rae Langton and Caroline West famously argue that pornography operates like a language game, in that it introduces certain views about women into the common ground via presupposition accommodation. While this pragmatic model explains how pornography has the potential to change its viewers’ beliefs, it leaves open how pornography changes people's desires. Our aim in this paper is to show how Langton and West's discourse-theoretic account of pornography can be refined to close this lacuna. Mere inability, which refers to what persons are naturally unable to do, is traditionally thought to be distinct from unfreedom, which is a social type of constraint. The advent of biomedical enhancement, however, challenges the idea that there is a clear division between mere inability and unfreedom. This is because bioenhancement makes it possible for some people’s mere inabilities to become matters of unfreedom. In this paper, I discuss several ways that this might occur: first, bioenhancement can exacerbate social pressures (...) to enhance one’s abilities; second, people may face discrimination for not enhancing; third, the new abilities made possible due to bioenhancement may be accompanied by new inabilities for the enhanced and unenhanced; and finally, shifting values around abilities and inabilities due to bioenhancement may reinforce a pre-existing ableism about human abilities. As such, we must give careful consideration to these potential unfreedom-generating outcomes when it comes to our moral evaluations of bioenhancement. (shrink)

This paper argues that in Eudemian Ethics 8.3, virtue’s mean between excess and deficiency is defined by the standard of promoting the most contemplation. Promotion is indirect and constrained by virtue’s other essential features. The chapter’s apparent restriction of the standard to actions concerning natural goods actually serves a dialectical, not a restrictive, purpose. This paper proposes to unify the chapter’s argumentative arc.

A global trend of institutionalised pronatalism situates low fertility as a site of demographic disaster – positioning primarily women’s bodies as both its cause and solution. In light of such demographic dread, assisted reproductive technologies (ART) may be utilized by pronatalist states as a strategy for fertility recovery, rather than as a benefit for individual aspiring parents. In other words, ARTs are at risk of being co-opted by nation-states for problematic demographic designs which do not advance emancipatory goals. The underlying (...) issue of pronatalism, however, is not always explicitly acknowledged in feminist bioethics as a barrier to ethical ART usage. In my paper, I argue that it would be a mistake to assume ART can be used for emancipatory ends if we do not, at the same time, critically investigate its connections to institutionalised pronatalism. This essay explores the theological and anthropological significance of birth, in order to discern what might be lost with the adoption of complete ectogestation (“artificial wombs”). Specifically, it considers both Saint Augustine and Karl Barth’s respective accounts of humanity’s whence—that is, their theological answer to the question of the nature and significance of our origins as individuals. I suggest that Augustine’s account of his origins emphasizes both his epistemic and biological dependency on his mother and nurses, while Barth’s stresses the (...) individual’s immediate derivation from God. Those disparate answers affect how they construe the relationships of parents and children and work themselves throughout their theological visions and imaginations. I conclude that careful consideration of humanity’s whence cannot answer whether we ought to pursue ectogestation; but it does help us account for how our understanding of God and ourselves might be altered if we gestate human life outside the womb. Crispin Wright has recently introduced a non-evidential notion of warrant – entitlement of cognitive project – as a promising response to certain sceptical arguments, which have been subject to extensive discussion within mainstream epistemology. The central idea is that, for a given class of cognitive projects, there are certain basic propositions – entitlements – which one is warranted in trusting provided there is no sufficient reason to think them false. The aim of this paper is to provide (...) an account of the notion of entitlement of cognitive project and briefly discuss the question whether there is any work for the notion of entitlement to do within the philosophy of mathematics. Bearing in mind its applications in mainstream epistemology, it will be suggested that the notion can be used to formulate a response to certain kinds of scepticism which call into question the warrantability of (acceptances of) propositions that appear integral to mathematical theorizing in a given mathematical theory T – in particular, that T is consistent and that T ’s background logic is sound. Psychologists sometimes discuss the need to refine clear designations of the observable units comprising their subject matter. This paper links such discussions to (a) Dewey and Bentley's (1949) account of specification as relatively accurate unit-designation, and (b) the logical base of scientific classifications and abstractions in observable particulars. The paper then reviews, clarifies, evaluates, and contrasts the psychological units proposed by Kantor (behavior segment), Skinner (operant), and Lee (deed). Overall, Lee's deed is found to be the sharpest, least ambiguous designation, (...) and the only specification. Deeds, fields of contributors, and contingencies are then used to selectively integrate aspects of all three units. The resulting integration is consistent with field-based approaches to causal relations within and among units, where the noun cause is synonymous with one of many contributors. It is also applicable to the analysis of feedback loops, which are designated as circular networks of dependency among subclasses of deeds. (shrink)

Although some psychoanalysts in the clinical field have criticised Žižek for corrupting Lacan’s teachings, through playing down the importance of the clinical, there is no doubt that Žižek’s scholarship and contribution to psychoanalysis displays mastery of Lacanian theory. Moreover, Žižek has applied this mastery to push theoretical ideas about the subject and social worlds, into public and intellectual debate. For Žižek, Lacan is a master from whom social knowledge as well as knowledge of the social is developed and critiqued. In (...) keeping with Žižek’s ontology, an examination of the intersection of belief with desire reveals the importance of a critical return to ideology that cannot be overlooked, particularly when examining how present social conditions structure an intersection of desire and belief. For Žižek, the contemporary subject believes now more than ever. Žižek positions modern social conditions together with the practices and organisations which maintain ideologies, as structuring the contours of belief. Capitalism, the supposed master of the 20th century, has presented as not so reliable. The harmony thesis about a virtuous person, widely held by neo-Aristotelians, supposes that someone highly vulnerable to temptation is not virtuous at all. However, is that the only plausible picture of a virtuous person’s psychology? This essay aims to offer an alternative picture by discussing the account of virtue in the thought of Mengzi 孟子 and his conception of moral exemplars. First, I analyze the Mengzian moral exemplar as depicted in _Mengzi_ 1A7—specifically, the susceptibility of the nobleman (_junzi_ 君子) to (...) compassion and the relevant temptation. Then, I explain how this differs from neo-Aristotelian virtue ethical theories. This passage shows that there is a certain price to being virtuous in Mengzi’s virtue theory. By examining various ways of addressing this challenge, I explore Mengzi’s solution to it, which will shed light on Mengzi’s own way of specifying virtue and its significant advantage as a potential alternative to certain other approaches. This dissertation is a study of how methodological issues in psychology can have significant implications for philosophical accounts of interpretation, justification, and psychological explanation. In the first chapter, I analyze traditional philosophical accounts of interpretation with an eye to identifying the ways in which philosophers have used rationality as a methodological tool. I argue that these forms of methodological rationalism do not successfully cope with the challenge from the heuristics and biases research program which generally argues that human judgment is (...) irrational. In the second chapter, I trace cognitive psychology's disciplinary trend to study conditions that facilitate rational rather than irrational judgment. This trend suggests we should seek to make rational judgment an object of study rather than a default methodology for the process of studying psychological judgment. I argue that social and moral interests in promoting cognitive health motivate and justify the interest in discovering conditions that promote rational rather than irrational judgment. I call this normative account of applied cognitive psychology ecological rationalism. In the third chapter, I argue that psychology's disciplinary interest in creating valid questionnaires motivates discovering the conditions of successful communication. I discuss the methodological lessons that the Gricean turn in psychological research brings to questionnaire design: in particular, the Gricean turn imposes evidential requirements on psychological research about the conditions of successful versus unsuccessful communication for specific contexts and the conversational norms governing communication in experimental conditions. In the fourth chapter, I argue that some methodological critiques of the heuristics and biases research program have intimate connections to naturalized epistemology: in particular, the ways in which Gerd Gigerenzer thinks cognitive processes should be specified for the sake of explaining human judgment suggest that cognitive psychology and naturalized epistemology are disciplines with shared explanatory goals. I argue that both invoke cognitive processes to explain the psychological transformation of inputs to output-beliefs; and both seek to explain the epistemic status of output-beliefs by reference to the same cognitive process invoked to explain its production. To close, I make a few observations on how the shared explanatory goals between cognitive psychology and naturalized epistemology recasts traditional challenges facing reliabilism. (shrink)

I defend Kant’s moral psychology against John R. Silber’s argument that Kant cannot account for the radical evil of Hitler. Silber’s argument cannot be maintained, I argue, if Kant’s account of theological and moral fanaticism, and the personality of the moral fanatic, are taken into account. I contend that Kant’s writings support an analogy between the fanatical pursuit of religious and moral ideals and Hitler’s fanatical pursuit of an ideal of racial purity. Toni Morrison suggests that storytelling is a highly effective way of structuring knowledge, and that the harnessing of a clever allegory, the search for well-patterned language is a constant, provocative engagement with the contemporary world. This article considers the ways poetry, imagination, and well-patterned language are utilized in the philosophies of Ralph Waldo Emerson, Richard Rorty, and Leonard Harris. The author notes that there are apparent similarities between Rorty and Harris, but one should also notice that there are significant differences (...) in these two philosophical positions. The author ultimately argues that Harris's move toward poetry and well-patterned language is extremely powerful and needed if people wish to move beyond a well-established set of values and norms. Harris prods us to tell thought-provoking, engaging stories—to intricately tuck knowledge into allegory and well-patterned language—but do it without being an apologist for the prevailing bourgeois liberal democratic tradition. In this manner, the harnessing of metaphor and clever allegory, the creative engagement with poetry and well-patterned language (in philosophy) is a provocative means of engaging the oppression, dispossession, and immiseration of the contemporary world. We live in an increasingly global, interconnected, and interdependent world, in which various forms of systemic imbalance in power have given birth to a growing demand for genuine pluralism and democracy. As befits a world so interconnected, this book presents a comparative theological and philosophical attempt to construct new underpinnings for the idea of democracy by bringing the Western concept of spirit into dialogue with the East Asian nondualistic and nonhierarchical notion of qi. The book follows the historical adventures of (...) the idea of qi through some of its Confucian and Daoist textual histories in East Asia, mainly Laozi, Zhu Xi, Toegye, Nongmun, and Su-un, and compares them with analogous conceptualizations of the ultimate creative and spiritual power found in the intellectual constellations of Western and/or Christian thought namely, Whitehead's Creativity, Hegel's Geist, Deleuze's chaosmos, and Catherine Keller's Tehom. The book adds to the growing body of pneumatocentric (Spirit-centered), panentheistic Christian theologies that emphasize God's liberating, equalizing, and pluralizing immanence in the cosmos. Furthermore, it injects into the theological and philosophical dialogue between the West and Confucian and Daoist East Asia, which has heretofore been dominated by the American pragmatist and process traditions, a fresh voice shaped by Hegelian, postmodern, and postcolonial thought. This enriches the ways in which the pluralistic and democratic implications of the notion of qi may be articulated. In addition, by offering a valuable introduction to some representative Korean thinkers who are largely unknown to Western scholars, the book advances the study of East Asia and Neo-Confucianism in particular. Last but not least, the book provides a model of Asian contextual theology that draws on the religious and philosophical resources of East Asia to offer a vision of pluralism and democracy. This work is the first English monograph on Franciscus Junius's (1545–1602) theology in more than 40 years, and also is the first monograph on Junius’s use of Thomistic moral concepts to date.

In this article, I defend a version of ontological pluralism, specifically with an eye toward laying metaphysical groundwork for an account of divine naming inspired by Avicenna. I try to show (1) that Avicenna’s pluralism is well-motivated as a metaphysical thesis and (2) that it offers substantive philosophical support for a correlatively pluralist approach to divine naming. My argument proceeds by identifying two influential objections to ontological pluralism, and then offering replies to these objections with the help of Avicenna. The (...) first objection pertains to pluralism as a position in general metaphysics, whereas the second pertains to pluralism as a position in theological epistemology or divine naming. To the extent that these replies are successful, I argue that Avicennian pluralism is compelling on both counts as a philosophical position. (shrink)
